Ken Salmon, Solicitor, Accredited mediator; MCIArb, Weightmans LLP Solicitors, Pall Mall Court, King Street, Manchester.

Ken has wide experience in both contentious and non-contentious construction matters. Ken sits on several legal panels and committees and routinely writes for the Arbitration Journal.

Synopsis

The outcome of any delay and any resultant extensions of time on construction projects can have a profound effect on the successful commercial outcome to the parties and any subsequent matters in dispute will sometimes need to be put to a third party.

Ken will discuss the question as to whether the judge/arbitrator/adjudicator has to stand in the architect/engineer/client's representative shoes when assessing entitlement to extensions of time.

Is the tribunal confined to looking at the question of delay based on what the certifier knew at the time he made or should have made his award? Or can it take into account subsequent events and actual outcome?

Reference will be made to the Building and Engineering standard forms.
