Mullberry appeals 38-home rejection
The Planning Inspectorate will decide the fate of the developer’s three-acre Barrow scheme after the local council refused the plans on various grounds.
In June 2024, Westmorland and Furness Council refused Mulberry’s application, which sought permission to build 38 properties on the land north of Sherborne Avenue.
The council pointed to the requirements of its Local Plan for high-quality design, which councillors determined the scheme would not deliver as it prioritises “quantity rather than quality”.
Additionally, the council decided the scheme “fails to present a coherent and consistent project”, with its reasoning including “inadequate dysfunctional parking arrangements”, and a “lack of usable public space”.
The application was submitted on Mullberry Homes’s behalf by Emery Planning and indicates the construction of a range of two- to five-bedroom properties, including four affordable homes.

Earlier this month the developer lost an appeal over the rejection of plans for 18 homes off Leece Lane in Barrow, less than a mile from Sherborne Avenue. Mullberry Homes also had a similar 32-home scheme planned in Dalton that was refused by the council in 2021.
