Interim rent – property litigation team
Interim rent often gets forgotten on a lease renewal because the default position is that the interim rent is fixed as being the same as the rent within the renewal lease. However, the default position does not always apply, particularly if either the landlord has opposed the grant of a new lease or no new lease has been granted. The property litigation team will look at the position with regard to this – with particular reference to two cases that were decided last year: Neale -v- Whitney Electric Theatre and Humber Oil Terminal Trustees Ltd -v- Associated British Ports.
Town and village green update – John Roberts, planning team
Applications to register land as a town or village green have in recent years become the tactic of choice deployed by groups opposed to development and are a major administrative issue faced by developers and local authorities. John Roberts considers the latest cases concerning such applications to come before the courts, together with the Government's proposed reforms of the town and village green system, within the Growth and Infrastructure Bill.
