Nestlé to build Buxton spa

North West law firms Brabners Chaffe Street and O'Connors have advised High Peak and Derbyshire Councils on the successful completion of legal agreements with Buxton water supplier Nestlé Waters to pave the way for a spa hotel.

Announcing completion of the discussions, which have been ongoing since 2003, Brabners said the spa would be only the second to draw water from underground to create a genuine spa in the UK in a century.

Nestle is working with developers CP Holdings and the Trevor Osborne Property Group to deliver the £32m transformation of The Crescent, a Grade 1-listed building in Buxton.

The project will deliver a 79-bedroom, 5-star spa hotel incorporating the neighbouring Natural Baths, natural thermal mineral water spa, eight specialist shops, a refurbished pump room and new visitor centre.

The legal agreements protect Nestlé's right, granted many years ago, to draw underground mineral water, under license from the Borough Council. The signing follows years of negotiations, test drilling and archaeological investigations to establish the feasibility of the development, details of which were first unveiled in 2003 by the two councils and a consortium of developers.

Brabners Chaffe Street Corporate Partner, Robert Street, assisted by Associate, Jamie Partridge, acted for High Peak Borough Council and Derbyshire County Council.

Charles Russell advised the developers; Norton Rose advised Nestlé and O'Connors advised the two councils on the insurance aspects of the transaction.
